The NCL has based its claims on the fact that the Railways had requested the Ministry of Energy, Coal Department, to lease 105.81 acres of land on October 24, 1988. The siding is used for transporting coal by various coal consumers. The NCL has stated in the report that the 35-bigha land is under the actual physical possession of the Railways and is used by the Railways for storage/transportation. The NCL has no right to store/transport coal to customers/buyers. The NCL's responsibility ends when the seller/buyer's loaded trucks pass through Clause Four (Mine Barrier/Checkpoint) at the Krishansila Railway Goodshed Siding. The NGT had previously ordered the NCL to deposit 10 crore rupees as environmental compensation and had also issued guidelines for remedial measures. The NCL had filed a review petition with the NGT, which was rejected.
