“fundamental error.” This decision stems from a 2008 public-private partnership between DMRC and DAMEPL for the construction and operation of the Delhi Airport Metro Express. The consortium faced financial difficulties and shut down operations in 2012, leading to a series of legal battles. ke ruling mein ek “fundamental error” tha. Yeh decision 2008 mein DMRC aur DAMEPL ke beech hue public-private partnership se aaya hai, jisme Delhi Airport Metro Express ka construction aur operation karna tha. Consortium ko financial difficulties aayi aur 2012 mein operation band kar diye, jisse legal battles ki series start hui. Ek arbitration panel ne 2017 mein DAMEPL ke favor mein decision diya, DMRC ko yeh bada amount dene ka order diya. Lekin Delhi High Court ne 2019 mein arbitration award ko overturn kar diya, tribunal ke decision mein errors hone ki wajah se. Supreme Court ne 2021 mein High Court verdict ko reverse kar diya, arbitration award ko uphold kiya. Ab, court ne yeh decision correct kar diya hai, apne pehle ke ruling mein fundamental error ko maan liya hai. Yeh decision public-private partnerships ki complexities aur aise arrangements mein disputes ko resolve karne ki challenges ko highlight karta hai.
