Delhi HC Upholds Railways' Decision To Suspend Catering Agency Which Carried LPG Cylinders On Board Trains Despite Directives Against Flame-Based Cooking

last-minute train handover and lack of flameless cooking facilities was not acceptable, as they had been providing services to the Railways since 2019 and should have been prepared for such eventualities. The Court also dismissed the argument that other service providers were using LPG cylinders without consequences, citing an action taken report showing that other companies' licenses were suspended or terminated. The Court concluded that the punishment imposed on Zenith was not disproportionate to the offense and declined to interfere, upholding the six-month suspension.

Court ne Ministry ke decision ko uphold kiya, yeh keh kar ki Zenith ka yeh justification ki last-minute mein train handover ho gaya aur flameless cooking ki facilities nahi thi, acceptable nahi hai, kyunki woh 2019 se Railways ko services provide kar rahe hain aur aise situations ke liye ready hona chahiye. Court ne yeh argument bhi reject kiya ki dusre service providers LPG cylinders use kar rahe the bina koi consequence ke, ek action taken report dikhaya jisme yeh bataya gaya ki dusre companies ke licenses suspend ya terminate kar diye gaye. Court ne yeh conclusion nikala ki Zenith ko diya gaya punishment offense se disproportionate nahi hai aur 6 mahine ke suspension ko uphold karte hue, court ne interference karne se mana kar diya.
