The railway officials claimed they had upgraded his seat to an AC coach but failed to provide evidence of informing him about the change. The senior citizen found his assigned seat occupied and was directed to another coach by the TTE, where he again found his seat occupied. The railway argued that the passenger had not arrived on time and his seat was given to another passenger at a higher fare. The court ruled in favor of the senior citizen, awarding him INR 1.96 lakhs as compensation including expenses incurred during the lawsuit.

Bujurg ko yeh yatra 19 February 2008 ko karni thi. Railway ne is beech bujurg ki seat ka upgrade karke unhe AC coach mein ek seat di thi. Halanki, railway peeth ke sammukh yeh sabit karne mein asafal raha ki unhone seat upgrade ki soochna bujurg ko di thi. Bujurg ne sunaai vyatha bujurg ne peeth ko di shikayat mein bataya ki ticket book karate samay unhe coach S4 mein seat number 69 aavantit ki gayi thi. 19 February 2008 ko woh train ke samay par Darbhanga station pahunche aur coach S4 mein chad gaye. Wahan pahunch kar unhone dekha ki unki seat par koi aur vyakti hai. Is par unhone coach ke TTE se sambandh kiya. TTE ne bataya ki unki seat ka upgrade kar diya gaya hai. Woh B1 coach ki seat number 33 mein chale jaayein. Jab woh Chhapra station par B1 coach mein pahunche to unhone paya ki yeh seat TTE ne kisi aur vyakti ko de di hai. Is par unka TTE se vivad hua. Railway ka peeth ke sammukh tark tha ki yatri samay se seat par nahi pahunche, isliye dusre yatri ka kiraya badhakar yeh seat unhe de di gayi thi.
